What to do right after an accident in California
- Get safe and call 911. A police report is powerful evidence. Ask for the report number.
- Get checked by a doctor today. Adrenaline hides injuries. Gaps in treatment are the number one excuse insurers use to cut payouts.
- Photograph everything. Vehicles, plates, the scene, skid marks, your injuries, the other driver's license and insurance card.
- Get witness names and numbers. Witnesses vanish. Phone numbers don't.
- Do not give a recorded statement to the other side's insurance company. Politely give them our number.

How long do I have to file an injury claim in California?
Generally two years from the date of injury (Code of Civil Procedure § 335.1). If a government vehicle or public property is involved, you usually must file a claim within six months (Government Code § 911.2). Call early. Evidence disappears fast.
What if I was partly at fault?
California uses pure comparative negligence. You can still recover, reduced by your share of fault. Being 30% at fault means you recover 70% of your damages. Don't let an adjuster talk you out of a claim.
Should I talk to the other driver's insurance company?
No. Adjusters record calls and look for anything that lowers your payout. Give them our number instead. That is what we are for.
What is my case worth?

Do I need a lawyer for a minor accident?
