Rideshare crashes involve a layered insurance system that trips up even experienced adjusters. California law (Public Utilities Code § 5433) requires transportation network companies to carry specific coverage depending on the driver's status.
The three coverage periods
- App off: the driver's personal auto policy applies.
- App on, waiting for a ride: Uber/Lyft coverage of at least $50,000 per person / $100,000 per accident / $30,000 property damage.
- En route to a pickup or carrying a passenger: $1,000,000 in liability coverage, plus uninsured/underinsured motorist coverage.
